On January 20, 2025, the Executive Order Declaring a National Energy Emergency (EO 14156) was issued by the White House, allowing broad latitude for Federal agencies to identify energy related undertakings as emergency actions. In response, ACHP has drafted guidance to aid agencies in implementing undertakings pursuant to the Executive Order. This guidance calls upon agencies to follow the terms of any applicable Section 106 agreement that contains emergency provisions or, in the absence of an agreement, utilize the emergency procedures outlined in 36CFR800.12(b)(2). These procedures would require agencies to notify appropriate parties of an undertaking and provide only seven days to comment.
To assist the process, ACHP will be updating a list of undertakings executed by Federal agencies pursuant to the Executive Order and sharing it monthly with NCSHPO. While SHPOs should be receiving direct notifications from the agencies seven days prior to the undertaking, as outlined in the regulations, NCSHPO is inviting members to also check the list below regularly, to ensure that notifications aren’t failing to reach them.
